Title 7 › CHAPTER 35 — AGRICULTURAL ADJUSTMENT ACT OF 1938 › SUBCHAPTER II — LOANS, PARITY PAYMENTS, CONSUMER SAFEGUARDS, MARKETING QUOTAS, AND MARKETING CERTIFICATES › Part B — Marketing Quotas › subpart iv — marketing quotas—cotton › § 1344b
Allows farm owners or operators to sell, lease, or move all or part of a cotton acreage allotment to another farm during the calendar years 1966 through 1970 if the Secretary of Agriculture decides it will not hurt the program. An owner can also move allotments between farms he owns or controls. Parties can agree how long a transfer lasts. Transfers have many rules. They cannot cross State lines. Moving allotments outside the originating county needs a county referendum within three years and a two-thirds yes vote. Transfers from mortgaged land need the lienholder’s OK. You cannot sell an allotment to a farm that already bought an allotment within the prior three crop years. A receiving farm’s total allotment cannot exceed its 1965 allotment (not counting reapportioned land) by more than 100 acres. After a sale, the farm that sold part or all its allotment may not plant cotton above its remaining allotment for five years; the same planting limit applies on a leased farm during the lease. A transfer is effective only after the county committee in the receiving county records it and finds it follows the rules; records may be filed only from June 1 to December 31. The transfer moves the acreage history, farm base, and marketing quota too. Land that loses its entire allotment cannot get a new farm allotment for five years. The Secretary will make rules, adjust allotments for yield differences, and allow special exchanges of cotton for rice allotments between nearby farms. Rules about payments under conservation contracts are adjusted only for the farm losing the allotment. These rules apply only to upland cotton.
