County committees may forgive some or all penalties when a farmer or producer illegally samples, moves, turns, or replaces grain or another commodity that is collateral for a Commodity Credit Corporation loan or held in a producer reserve. Forgiveness can only happen if the committee finds the act was accidental, due to not knowing the rule, or done to stop spoilage, and if no one’s rights were harmed. The committee must send its decision to the Administrator of the Agricultural Stabilization and Conservation Service and the State committee, who can reject it within 60 days. If not rejected in 60 days, the decision is approved.
