If the Secretary finds a State did not follow rules under this subchapter and so cannot get part or all of the funds it would otherwise receive for programs under section 2662(a) and (b), the Secretary will report the facts and reasons to the President. The withheld amount will be held apart in the Treasury until the end of the next Congress after the State legislature’s session so the State can appeal; if that Congress does not order payment, the money will become part of the Treasury. If money that a State’s designated officers receive for these programs is diminished, lost, or misused, the State must replace it.
