§4812 Suspension and Termination of Orders

Summary

If, after the first required vote, the Secretary finds that an order or part of it blocks or does not help the law’s goals, the Secretary must stop or pause that order or part. If at least 15 percent of people who have been producers and importers during a representative period ask for it, the Secretary must hold a referendum for producers and importers to decide whether to end or pause the order. If a majority of those voting favor ending or pausing the order, the Secretary must stop collecting assessments within 6 months and then end the order as soon as practical. Except for the first required vote, the Secretary will not have to hold more than one such referendum in any 2-year period. Ending or pausing an order is not treated as an order under the law.
