ORR Chief Can Approve Special Immigrant Status
The Office of Refugee Resettlement delegates to the Chief of the Unaccompanied Children Bureau the authority under the William Wilberforce Trafficking Victims Protection Reauthorization Act of 2008 section 235(d)(1) to consent to juvenile court jurisdiction for an unaccompanied alien child applying for special immigrant juvenile status under the Immigration and Nationality Act (8 U.S.C. 1101(a)(27)(J)) who is in the custody of the Secretary. This delegation is effective on the date of signature. It must be exercised under existing Department delegation, regulatory policy, and Administration for Children and Families financial and administrative requirements.
Affirmation of Prior Consents by Bureau Chief
The Director affirms and ratifies any actions that the Chief of the Unaccompanied Children Bureau took before the effective date that, in effect, involved exercising these authorities to consent to juvenile court jurisdiction for special immigrant juvenile status. This confirmation is part of the same delegation and is effective on the date of signature.
