75‑Day Moratorium on Federal Enforcement
The President ordered the Attorney General not to enforce the Protecting Americans from Foreign Adversary Controlled Applications Act for 75 days starting January 20, 2025. During this period, the Department of Justice will not take action or impose penalties for distributing, maintaining, or updating TikTok or apps operated by ByteDance in the United States.
Retroactive Protection From Penalties
The order directs that the Department of Justice shall not impose penalties or take enforcement action for any conduct that occurred during the 75‑day moratorium or at any time before the order, including conduct from January 19, 2025 until the signing of the order. The Attorney General is also directed to issue guidance and letters stating there is no liability for providers for that period.
Act Covers ByteDance‑Operated Apps
The Act defines a "Foreign Adversary Controlled Application" to include websites, desktop applications, mobile applications, and augmented or immersive technology applications operated directly or indirectly by ByteDance Ltd. or TikTok. The Executive Order notes the prohibitions in section 2(a) of the Act became effective on January 19, 2025.
