Duty Dodgers Beware: Commerce Seeks Import Tax Reviews

Request Review by Feb 2025 Deadline
If you import goods covered by any of the listed antidumping (AD) or countervailing duty (CVD) orders, you must request an administrative review no later than the last day of February 2025. If Commerce does not receive a request by that date for a listed order and period, Commerce will instruct U.S. Customs and Border Protection (CBP) to assess duties on those entries at the cash-deposit rate and to continue collecting the cash deposit.
Nonmarket-Economy (NME) Entity Review Treatment
Commerce will not treat the non-market-economy (NME) entity as an exporter for administrative review unless a party requests or Commerce self-initiates a review of the NME entity. If no review of the NME entity is conducted and an individual exporter does not qualify for a separate rate, Commerce will treat that company as part of the NME entity and will instruct CBP to liquidate entries for exporters not named in the initiation notice.
CBP Data Release and 35-Day Selection Timeline
If Commerce limits the number of respondents for an administrative review, it will use CBP import data for respondent selection. Commerce intends to release CBP data under an Administrative Protective Order (APO) to parties with an APO within five days of the initiation notice and to make respondent-selection decisions within 35 days; parties may comment within five days after the CBP data is placed on the record and are encouraged to submit APO applications promptly.
Particular Market Situation (PMS) Submission Deadline
If you wish to submit a particular market situation (PMS) allegation under section 773(e) that could change how Commerce calculates constructed value, you must submit the PMS allegation and supporting factual information no later than 20 days after submission of initial Section D responses.
Annual Inquiry Service List — 30-Day Update
Commerce will update annual inquiry service lists for the listed AD and CVD proceedings and interested parties must submit new or amended entries of appearance within 30 days after the date of this notice; Commerce will finalize the lists five business days thereafter. Petitioners and foreign governments that filed an entry of appearance once will be automatically retained on the annual inquiry service list in subsequent years but must amend their entry when contact information or representation changes.
