Commerce determined that certain hardwood plywood from the People’s Republic of China was sold in the U.S. at below normal value and received countervailable subsidies during the period of review September 26, 2021 through December 31, 2022. These final findings mean antidumping and countervailing duty measures apply to this merchandise and can affect import duties charged to U.S. importers and buyers.
Four Firms Treated as China‑Wide Entity
Commerce determined that four companies subject to the antidumping review are part of the China‑wide entity because they did not demonstrate eligibility for separate rates. Those four companies will be treated with the China‑wide entity in the review and associated measures.
Adverse Facts Available Applied to Several Firms
Commerce applied facts available with an adverse inference (AFA) to five companies in the antidumping review and eight companies in the countervailing‑duty review because the conditions of sections 776(a) and (b) of the Tariff Act of 1930 were satisfied. The AFA application can lead to adverse duty determinations for those specific companies.
No-Shipments Certifications Granted
Commerce found that 16 exporters (under the antidumping review) and 15 companies (under the countervailing-duty review) had no shipments of the subject hardwood plywood during September 26, 2021 through December 31, 2022 and have demonstrated eligibility to certify that future shipments are not subject merchandise. This allows those specific exporters/companies to seek certification that future shipments are not covered by these AD/CVD determinations.
