Northern States Power Company is issued an annual license to operate the White River Hydroelectric Project for the period August 1, 2025 through July 31, 2026, or until a new license or other disposition under the Federal Power Act (FPA) is issued. The project continues to operate under the terms and conditions of the prior license during that period.
Automatic renewal if no new license issued
If a new license or other disposition for the project is not issued on or before July 31, 2026, the annual license automatically renews without further order or notice under 18 CFR 16.18(c), unless the Commission orders otherwise. This automatic renewal continues the project's authorization beyond July 31, 2026 until the Commission acts.
Continuation under prior license if not subject to §15
If the White River Project is not subject to section 15 of the FPA, Northern States Power Company is authorized to continue operating the project under the terms and conditions of the prior license until a subsequent license is issued or other disposition under the FPA occurs. The notice cites 5 U.S.C. 558(c) and 18 CFR 16.21 as the legal basis for continued operation in that case.
