How Assessment Rates Will Be Applied

If Commerce finalizes rescission, it will instruct Customs and Border Protection (CBP) to liquidate the relevant entry at the all-others' rate. If Commerce does not rescind, duties will be assessed per 19 CFR 351.212(b)(1): entries will be liquidated without regard to duties if the respondent's weighted-average dumping margin is zero or de minimis (0.5 percent), but if the margin is above 0.5 percent Commerce will calculate importer-specific assessment rates; Commerce intends to issue assessment instructions to CBP 35 days after publication of the final results.

Cash Deposit Rate Rules for Essen Steel

If Commerce rescinds the review, Essen Steel's cash deposit rate will continue to be the all-others rate because no individual weighted-average dumping margin would be determined. If Commerce determines an individual weighted-average dumping margin for Essen Steel, CBP will collect cash deposits equal to that calculated margin effective upon publication of the final results.

Importer Reimbursement Certificate Requirement

Importers must file a certificate regarding reimbursement of antidumping duties prior to liquidation under 19 CFR 351.402(f). Failure to file this certificate could lead Commerce to presume reimbursement occurred and result in the assessment of double antidumping duties.

Essen Steel NSR Preliminary Rescission

Commerce preliminarily found that Essen Steel did not make a bona fide sale during the period of review, February 1, 2024 through July 31, 2024, and preliminarily intends to rescind the new shipper review. This preliminary determination is applicable November 26, 2025 and affects how Essen Steel's shipments are treated under the antidumping order.
