Vietnam-made Aluminum Found Circumventing Orders

The Department of Commerce preliminarily found that disposable aluminum containers completed in Vietnam using aluminum foil produced in China are circumventing the antidumping and countervailing duty orders on imports from China. Commerce preliminarily includes this Vietnam-made merchandise within the scope of the China Orders, effective April 20, 2026.

Suspension of Liquidation and Huge Cash Deposits

Commerce will direct Customs to suspend liquidation and require cash deposits on unliquidated entries of the Vietnam-completed merchandise entered or withdrawn for consumption on or after October 28, 2024. Commerce says it may require deposits at the China-wide AD cash deposit rate of 287.80 percent and the CVD all-others cash deposit rate of 317.85 percent, unless a company has its own company-specific rate.

Certification and Document Upload Requirement

Importers and exporters must complete specific certifications and upload the importer certification, exporter certification, commercial invoice, bill of lading, and the aluminum mill certificate (identifying country of smelt and cast) into CBP's Document Imaging System in ACE at the time of entry. For unliquidated entries between October 28, 2024 and May 6, 2026, those documents must be uploaded, and certifications completed and signed, no later than June 5, 2026.

Non‑Chinese Foil Means No Cash Deposit Requirement

Aluminum containers completed in Vietnam that are made from aluminum inputs that are not of Chinese origin are not subject to this circumvention inquiry and do not require the cash deposits under the China Orders. Importers/exporters can avoid suspension and deposits by certifying and documenting that the aluminum input is not Chinese-origin.

Post‑Summary Corrections and Payment for Certain Entries

For unliquidated entries made between October 28, 2024 and May 6, 2026 that were declared as non-AD/CVD entry types (e.g., type 01) and for which certifications cannot be made, importers must file a Post Summary Correction converting the entry to an AD/CVD type (e.g., type 03) and pay the required cash deposits consistent with the applicable regulations.
