Petroleum Capacity Declared Critical
The President determined on April 20, 2026 that domestic petroleum production, refining, and logistics capacity are essential to national defense. This includes exploration and production, gathering and transmission pipelines, storage, and marine terminals, which are now officially treated as industrial resources or critical technology items under section 303(a)(5) of the Defense Production Act.
Federal Purchases and Financial Support Authorized
The Secretary of Energy is authorized to make purchases, purchase commitments, and provide financial support or other financial instruments to develop domestic petroleum production, refining, and logistics projects pursuant to section 303 of the Defense Production Act. The determination to implement these actions was issued on April 20, 2026.
Statutory Requirements Waived to Speed Action
For the purpose of expanding petroleum production, refining, and logistics capacity, the President waived the requirements of section 303(a)(1) through 303(a)(6) of the Defense Production Act pursuant to section 303(a)(7). This waiver was made in the April 20, 2026 determination to allow more rapid implementation.
