Federal OSHA Enforces Federal Sites
Starting April 27, 2026, private-sector employees working on land that the United States owns or leases in Maryland will be covered by federal OSHA instead of the Maryland State Plan (MOSH). This clarification applies where federal employees are regularly present, at federal government-owned contractor-operated sites, and on federal property under construction.
Federal Anti-Retaliation Enforcement Remains
Federal OSHA retains enforcement of the OSH Act's anti-retaliation provision, Section 11(c) (29 U.S.C. 660(c)), with respect to the private sector in Maryland. The Maryland State Plan also investigates private-sector and state/local workplace retaliation cases under a similar provision.
