Agency Finds Likely Safety Improvement

FMCSA determined granting the exemption would likely achieve a level of safety equivalent to or greater than without the exemption. The decision cites that rear-end crashes account for approximately 30 percent of all crashes, that large trucks were about three times more likely to be struck in the rear in two-vehicle fatal crashes (2010–2016), and NHTSA research showing amber rear turn signals reduced involvement in certain two-vehicle crashes by 5.3 percent.

Five-Year Amber Brake Lamp Exemption

Yarde Metals, Inc. (USDOT No. 299202) may install an amber, brake-activated, pulsating auxiliary lamp on the rear center outside frame rail of each of its commercial motor vehicles in addition to the required steady-burning brake lamps. The exemption is effective April 28, 2026 through April 28, 2031, and applies exclusively to Yarde Metals' CMVs.

State Preemption for Exempted Operations

While the exemption is in effect (April 28, 2026–April 28, 2031), no State may enforce any law or regulation applicable to interstate commerce that conflicts with or is inconsistent with this exemption with respect to a firm or person operating under the exemption. States may, but are not required to, adopt the same exemption for intrastate operations.
