Five-Year Exemption Granted

FMCSA granted Atlantic Aviation Orlando an exemption allowing four jet-fuel service trucks to have exhaust systems that discharge forward of the cab. The exemption is effective April 28, 2026 and expires April 28, 2031, 11:59 p.m. local time.

Strict Operational Limits Set

The exemption applies only to four identified vehicles (JT-01, JT-03, JT-04, and JT-07) and only for operations at Orlando International Airport and along the authorized route between the airport fuel farm and Atlantic Aviation's facility at 9245 Tradeport Drive. Atlantic Aviation must maintain the forward-discharge exhausts in compliance with NFPA 407 and obey all other applicable FMCSRs.

Federal Preemption of Conflicting State Rules

While the exemption is in effect (April 28, 2026 through April 28, 2031), no State may enforce a law or regulation applicable to interstate commerce that conflicts with this exemption for a firm or person operating under it. Florida may, but is not required to, adopt the same exemption for intrastate operations.

Exemption Can Be Revoked

FMCSA will revoke the exemption if Atlantic Aviation fails to comply with the terms and conditions, if the exemption causes a lower level of safety than before, or if continuing it would conflict with the goals of 49 U.S.C. 31136(e) and 31315(b).
