No Labor Protections Will Be Imposed
If you work for NEAR or other Class III rail carriers involved in this transaction, the Board will not impose labor protective conditions because the transaction involves only Class III carriers and 49 U.S.C. 11326(c) does not provide for labor protection in such cases.
Short Line Lease and Operation Begins
If you operate a business in the Doraville Industrial Complex, Northeast Atlanta Railroad (NEAR) will lease and operate about 1.15 miles of track from Norfolk Southern into the Doraville Industrial Complex. The continuance-in-control exemption lets Jaguar continue control of NEAR and allows the lease and operation to proceed as soon as May 30, 2026, without prior Board approval.
