Restore VA education benefit time

If enacted, the Secretary would restore VA education entitlement time for veterans and other covered students when VA payments were made during certain problematic school periods. Payments made on or after the date of enactment for VA-approved programs would not count against your total entitlement or the aggregate period under current law. "Covered educational assistance" would include benefits under chapters 30, 31, 32, 33, or 35 of title 38 and chapters 1606 or 1607 of title 10. Covered periods would include times when a school lacked state approval, had approval revoked, was found by VA or a court to have violated rules or committed fraud, was closed by the Department of Justice for fraud or law violations, or engaged in fraud and later closed.

Schools must repay VA for fraud

If enacted, VA approval of a course or program would require an institution to agree to repay any amounts the institution received that correspond to restored entitlement for a covered individual. If a court finds a school guilty of or liable for fraud and orders financial relief, the Secretary would be able to file a claim with the Department of the Treasury to recoup VA education payments obtained through that fraud. Institutions or their owners that are told to repay money would be able to request a separate review of the repayment finding that is distinct from the current VA review process. The repayment rule for approval applies when the Secretary restores an individual's entitlement under the restoration provision.
