Access to Reproductive Care for Servicemembers Act
Sponsored By: Representative Sherrill
Introduced
Summary
Guarantees time-sensitive leave for non-covered reproductive health care for servicemembers and their dependents. This bill would create a clear entitlement to prompt leave for reproductive care that military rules do not cover, require travel reimbursement when timely care is not available nearby, protect privacy for those seeking care, and bar punishment or reprisal for using these rights.
Show full summary
- Servicemembers: Would receive a formal leave right for non-covered care including abortions not permitted under current law and specific assisted reproductive technologies. Travel costs would be reimbursed when prompt care is not accessible near a duty station.
- Families and dependents: Would gain protected time off for fertility treatments such as ovarian stimulation, egg retrieval, intrauterine insemination, and in vitro fertilization, reducing scheduling and access barriers.
- Command climate and equity: The bill forbids adverse actions and privacy breaches when members seek care, and it targets barriers that disproportionately affect lower-income, junior enlisted, BIPOC, immigrants, young people, people with disabilities, LGBTQI+ individuals, and those overseas or in rural areas. The Department of Defense estimates 20–30 percent of members have experienced sexual assault or PTSD linked to infertility.

Bill Overview
Analyzed Economic Effects
3 provisions identified: 3 benefits, 0 costs, 0 mixed.
Protected leave for service members' reproductive care
If enacted, the military would have to treat certain reproductive care as time‑sensitive. Commanders would have to approve leave for a member or their dependent to get that care. Providers and commanders would need to protect your privacy when you ask for leave and when you return. They could not force you to say what procedure you got. They could not punish you for asking for, taking, providing, or approving this leave.
Travel pay when reproductive care is not nearby
If enacted, the military would repay travel costs when timely care is not available near you. You could get money back for meals, tips, taxes, and lodging. Round‑trip transportation would be covered. If you request it, standard travel pay could cover an escort or attendant. This would apply only when timely access to the service is not available near your location.
Which reproductive services would qualify
If enacted, the bill would define which services count as non‑covered reproductive care. It would include abortion care not allowed under 10 U.S.C. 1093 and fertility care such as egg retrieval, sperm collection, intrauterine insemination, and in vitro fertilization (including fresh and frozen embryo transfers and other listed methods). These definitions would decide which services can get the leave, privacy, and travel pay in this bill.
