Bill Overview

Analyzed Economic Effects

3 provisions identified: 1 benefits, 0 costs, 2 mixed.

No masks; ICE agents wear name tags

If enacted, ICE agents in the United States would not be allowed to wear face coverings during arrests, raids, questioning, or similar actions. They would have to wear clothing that clearly shows their name and that they are with ICE. Exceptions would apply for imminent threats or when safety or medical gear is required. Any use of an exception would have to be documented and reviewed by a supervisor within 48 hours. If misused, the supervisor would have to start a disciplinary review. The rule would take effect 30 days after enactment.

DHS complaint and discipline process

If enacted, the Secretary of Homeland Security would set rules to enforce this bill. The Office for Civil Rights and Civil Liberties would be able to take and review complaints about violations. Agents who break the rules would face disciplinary review and possible sanctions. Each year, the Secretary would report to Congress on complaints and disciplinary actions.

What counts as agents, masks, operations

If enacted, the bill would define who counts as an ICE agent, what an enforcement operation is, and what a facial covering includes. It would also define that the United States includes states, D.C., and territories. If a court strikes part of the bill, the rest would still apply. The bill would take effect 30 days after enactment.
