Before new entry rules are in place, the department may issue you a resident or nonresident commercial menhaden license. You must have held a menhaden license in 2019, 2020, or 2021. You must also have at least 20,000 pounds of legal landings in one of those years, proven with records reported before January 1, 2023. You also must not have qualified for or received a license under subsection 1-A.
The law creates a limited-entry system when there are fewer than 350 menhaden licenses and the exit ratio is one to one. People who did not hold a license last year can qualify under this system, but those rules are paused until all priority people are offered licenses. Before rules are adopted, preference goes to people who meet subsection 1‑E, ordered by the town farthest east, with a random draw within a town. The department must assign licenses as soon as possible after the law takes effect and adopt the entry rules by December 31, 2027.
