Clear terms and easy online cancellation for subscriptions

Sellers must show clear, easy-to-find renewal terms and how to cancel. They must get your express OK, like a checked box or e-signature, before any automatic renewal. You must be able to cancel online the same way you signed up. If a phone number is offered to cancel, it must be toll-free. Disclosures must state the charge amount, how often it bills, and the refund policy, and ads cannot mislead. Sites that only host an Internet game are not treated as the seller. These rules apply to offers or agreements entered into or renewed on or after January 1, 2026.

Extra protections for long-term renewals

Plans with a term of 12 months or more that renew for more than one month are covered. You must cancel affirmatively to stop renewal. For these long renewals, sellers must send a reminder 30 to 60 days before the cancellation deadline. The notice must say it will renew unless you cancel and tell you where to find renewal and cancellation details, with an online cancel option. These protections apply to offers or agreements entered into or renewed on or after January 1, 2026.

Triple refunds and tougher enforcement on renewals

If a seller bills you without authorization, they must refund three times the unauthorized amount. Breaking these rules is also a violation of the Maine Unfair Trade Practices Act. The Attorney General enforces these rules and can set technical rules. No UTPA action is allowed if the violation was an error and the seller gives a full refund for all amounts from the renewal date until termination or the next renewal notice. These enforcement rules apply to offers or agreements entered into or renewed on or after January 1, 2026.

Gym memberships covered by renewal rules

Health club memberships are covered by the automatic renewal rules starting January 1, 2026. A health club is a gym, fitness center, or health studio. Nonprofits, schools, government-run sites, places where fitness is incidental, and health care facilities are not covered. A membership includes online and app sign-ups and any deal where you pay for ongoing access. Covered services include equipment, classes, pools, courts, and other fitness amenities.
