Child-safe packaging, no copycat labels

Potentially intoxicating hemp products must use child-resistant, tamper-evident packaging. Beverages, salves, and topical products are excluded. Labels and packaging cannot violate federal trademark law or mimic other brands in a way that confuses shoppers. These rules take effect June 24, 2025.

Defines which hemp products are intoxicating

The law names nonintoxicating cannabinoids like CBD, CBG, and CBN. It lists potentially intoxicating cannabinoids such as delta‑8, delta‑9, and delta‑10 THC, related isomers and metabolites, and HHC. An ingestible hemp product is “potentially intoxicating” if it has 0.3% or more of these cannabinoids, or a nonintoxicating‑to‑intoxicating ratio of 10:1 or less. These definitions guide sales and packaging rules starting June 24, 2025.

No intoxicating hemp sales under 21

Retailers cannot sell potentially intoxicating hemp products to anyone under age 21. Sellers must check and verify ID. The rule starts June 24, 2025.
