Sales ban for bottle deposit nonfilers

The law requires initiators in Maine’s bottle deposit system to file an annual report. An initiator that does not file commits a violation and faces penalties under section 3111. While the violation exists, that initiator cannot sell or distribute covered beverage containers in Maine. Distributors and dealers also cannot sell those containers. The department can remove the initiator’s containers from sale.
