Certain construction and demolition (C&D) waste facilities must hit rising reuse and recycling targets. To be covered, a facility was operating in 2018, takes only C&D debris, and took over 200,000 tons that year. It must reuse or recycle at least 15% by July 1, 2026; 20% by July 1, 2027; 30% by July 1, 2028; 40% by July 1, 2029; and 50% by July 1, 2030. The percentages count only reuse or recycling, not placing material in a landfill.
The state provides $150,000 in fiscal year 2025–26 and $150,000 in 2026–27 to the Department of Environmental Protection. The money is one-time and comes from tipping fee revenue. It supports the agency’s Remediation and Waste Management program.
From June 23, 2023 through July 1, 2027, some excess residue at a state-owned landfill counts as in-state waste. In any 12 months, up to 25,000 tons of oversized bulky waste placed there counts as in-state. In the same 12 months, up to 75,000 tons of other excess residue used as daily cover also counts as in-state. Any residue beyond those caps does not count as in-state.
