Cities, villages, and townships are capped at one distributor license per 3,000 people and one merchant license per 1,000 people. The commission can waive a cap if no licensed store of that type is within 2 miles by the nearest driving route. The merchant cap does not apply to class C, class A or B hotel, club, tavern, class G‑1 or G‑2 licensees, large stores with 20,000+ square feet and at least 20% food sales, pharmacies, secondary location permits, 2017 fuel‑dealer waiver licenses, or marina licenses under section 539. Population counts use the latest federal census, approved special censuses, or Census Bureau corrections. A grocery on Schoolcraft College land can get a merchant and/or distributor license if quotas allow.
You can hold a distributor license with a merchant license, and with a class B hotel or class C license. When a distributor license is held with a class B or class C, your annual fee is based on last year’s combined retail purchases from the commission under both licenses.
A merchant license may be transferred to a location in any local unit within the same county; if the original local unit spans two counties, transfer to either county is allowed. If moved to a different local unit, the license still counts against the original unit’s quota. The population cap does not block renewals or transfers for merchant licenses issued or renewed before, on, or after January 4, 2017. But some merchant licenses issued after January 4, 2017 under specific provisions cannot be moved to a new site.
The commission only issues or transfers a merchant license to approved business types. You must already hold or be approved for one: a retail food establishment license, a specially designated distributor license, or one of these liquor licenses—class C, class A hotel, class B hotel, club, tavern, class G‑1, or class G‑2. Holders of a specially designated distributor license may also apply for a merchant license.
If you own or run a motor‑fuel pump on or next to your store, you do not have to meet the old section 541 conditions. Retail fuel dealers who applied within 60 days after January 4, 2017 with a valid Motor Fuels Quality Act license received a quota waiver. If a marina operates or has a financial stake in fuel pumps, it may receive a merchant license only under section 539.
This amendment takes effect only because House Bill 4282 also became law. The licensing changes in this act are now in force.
