Beginning July 1, 2026, a data center may buy power and related services from an in‑state independent generator. The generator may connect behind the data center’s meter; if the center also takes utility service, written utility approval is required. Sales that use utility or TVA lines happen only on the line owner’s terms and under federal law. These generators are not treated as public utilities just for selling to a data center.
Beginning July 1, 2026, cities and electric utilities cannot pay the electrical infrastructure costs to serve a data center. A utility may shift costs only when upgrades extend beyond the data center and can also serve others. The shift must relate to repairs or replacements others first funded and follow the utility’s standard policies. Utilities may reimburse a data center only under policies for comparable customers, without giving better terms or raising existing rates. If Tennessee Valley Authority terms or federal law conflict, those rules control.
