Beginning with the 2026–2027 school year, the state can offer up to 35,000 Education Freedom Scholarships if the legislature funds them. The department gives awards in this order: 1) students who had a scholarship last year; 2) students with income at or below 100% of the USDA free/reduced‑price lunch level, or students eligible under § 49-6-2602 or § 49-10-1402; 3) students with income at or below 300% of that level; 4) students above 300% who are in a public school now or eligible to start kindergarten; 5) other students above 300%. Within each group, awards follow the order applications are received. The law also makes clear that “enrolls in” covers any K–12 grade.
Beginning in 2026–2027, the state gives a district extra money for each student who left last year and used an Education Freedom Scholarship, if the district’s current TISA state allocation is lower than last year and it had disenrollment. For 2026–2027, the total extra money cannot be more than the district’s prior‑year TISA allocation. From 2027–2028 on, the cap is last year’s TISA plus any extra funds the district got then. These backfill payments use only state funds. If more than one funding rule applies, the department uses the one that pays the most.
