Breaking these 340B rules counts as an unfair or deceptive act under state law. The state can fine violators $50,000 per violation, and each package tied to a violation counts separately. This strengthens enforcement for 340B providers.
Starting July 1, 2025, contractors that dispense or manage 340B participation cannot interfere with a 340B provider’s contracts or business relationships. They cannot restrict which 340B drugs the provider chooses to buy, deliver, or give out. They also cannot set terms that exclude claims in a way that causes the provider a net loss.
Starting July 1, 2025, drug makers and their agents cannot make 340B providers hand over extra data just to get 340B drugs, unless HHS or state law requires it. They cannot force special inventory systems unless required by law. They cannot make 340B claims be reversed or resubmitted after they are paid, unless it is a normal business fix not tied to 340B. Audits and credentialing for 340B providers cannot be tougher than for similar non‑340B providers. The Tennessee attorney general can block any rule that interferes with a provider’s access to 340B discounts.
These rules cannot conflict with federal law, including federal limited‑distribution requirements. The section does not apply to TennCare, CoverKids, or the state prescription drug discount plan under Title 56, Chapter 57.
Starting July 1, 2025, drug makers and their agents cannot deny or limit the sale or delivery of 340B drugs to covered providers or their authorized locations. This does not apply where HHS or state law bars the sale. Limits already in place on or before June 1, 2025 stay in effect.
