Beginning May 6, 2026, when a child enters state custody, the department checks within 60 days if the child gets or can get federal benefits. If eligible or possibly eligible, the department applies for the benefits and rechecks after major changes. The department applies to be the child’s representative payee and serves if appointed. Each year, it reviews whether someone else should be the payee for the child’s best interest.
Beginning May 6, 2026, the department keeps each child’s federal benefits in a separate account. If the child qualifies, it uses an ABLE account unless it documents good cause; otherwise it picks the best option, like a 529 plan or a special needs trust. It must manage funds in the child’s best interest and not jeopardize eligibility for other programs. It may spend up to 25% of each deposit on maintenance and must save or invest the rest. Each year, the child and guardian ad litem get a full statement. When custody ends, the department transfers the account and offers financial training. It also writes rules to define good cause, set safeguards, and follow federal law.
