Ban on non-pure kratom, tougher penalties

Beginning May 6, 2026, processors and retailers may not prepare or sell any kratom product that is not pure leaf kratom. A first violation is a class B misdemeanor, a second is a class A misdemeanor, and later violations are a third-degree felony. Sellers also may not sell kratom to anyone under 21; each sale is a class A misdemeanor.

Kratom sellers must register and label

Beginning May 6, 2026, kratom processors must register as a food establishment and as a kratom processor. Retailers must register with the department. The department sets registration fees and a separate fee for product registration; a product is not registered until the fee is paid. Packages must list the amounts of mitragynine and 7-hydroxymitragynine, and processors must state the factual basis for calling a product kratom. The department can fine up to $5,000 and seize and destroy unregistered products. Updated definitions expand who and what counts under these rules. The law also repeals Section 4-45-101.

Export-only window for some kratom

Beginning May 6, 2026, processors may handle non-pure kratom only for export under strict limits until March 6, 2027. The product cannot be offered for sale in Utah, must be made for lawful sale in another state, and must have 7-hydroxymitragynine at 0.4% or less of total alkaloids. During this period, people who follow these rules are not subject to certain controlled-substance penalties for 7-hydroxymitragynine.

Protection for compliant pure leaf kratom

Beginning May 6, 2026, if you possess, make, or sell pure leaf kratom and follow the Kratom Regulation Act, you are not subject to controlled-substance penalties for 7-hydroxymitragynine. This protection applies only when you comply with all Chapter 45 rules.
