Beginning May 6, 2026, the board meets to review license applications and decide them. It must hold a public hearing for major changes like 20% or more ownership changes, location changes, tier upgrades, extraction or formulation changes, or adding hemp processing at the same site. The board may interview applicants. For renewals, a representative must attend or submit data on biomass, methods, products, and operating practices. In a location‑change hearing, the board may weigh access, quality, variety, and effects on patient costs. Information you mark as business‑confidential under state law is protected from disclosure. The board can work with the attorney general to investigate anticompetitive conduct.
Beginning May 6, 2026, the law creates a Cannabis Licensing Advisory Board. The commissioner appoints members, and the governor confirms them. The board includes a public member and experts like a pharmacist, chemist, accountant, law enforcement, and a patient‑recommended member, and may add one industry expert. Members must meet conflict‑of‑interest rules and serve four‑year staggered terms. A quorum is five; the commissioner or designee chairs the board and may cast a deciding vote. The commissioner can remove members for cause. Members get per diem and travel, but no salary. The department staffs the board and helps run meetings.
Beginning May 6, 2026, the board can issue up to 17 medical cannabis pharmacy licenses statewide. The department divides Utah into at least four regions to spread pharmacies and maximize cardholder access. Licenses are awarded using the regions and go to applicants with strong experience, safety and security plans, good locations, and plans to improve efficiency and lower patient costs. The board may give extra weight to pharmacies that serve medically underserved areas and that offer home delivery with electronic orders. An existing pharmacy cannot move to a site outside its current region.
