Beginning May 6, 2026, your auto insurer must give you written notice before it can specify non‑OEM crash parts. The notice must say these parts are not made by your vehicle’s manufacturer. If your insurer allows or requires non‑OEM parts, your repair estimate must list each one and include a 10‑point‑font disclosure that parts must be equivalent in fit, quality, and performance, and that warranties come from the part maker or distributor. For policies issued on or after October 1, 2026, your insurer also gives you a written or electronic notice at sale and at renewal that it may use aftermarket parts. That policy notice is informational only and does not change your coverage.
The law defines key terms for crash‑part repairs, including aftermarket crash part, non‑OEM, OEM, installer, insurer, and repair facility. These definitions apply to the people and parts covered by the new repair rules. The law takes effect May 6, 2026.
The law does not create any extra insurer warranties beyond your policy. Insurers do not have to cover OEM parts unless your policy says so. It also says state insurance regulators are not required to enforce the repair‑estimate disclosure rule. These limits apply starting May 6, 2026.
