Microschools allowed everywhere with faster permits

Beginning May 6, 2026, cities and counties must allow charter schools, home-based microschools, and micro-education entities in every zone. Land-use and building permit applications for these schools get first-priority processing. Parking rules cannot exceed the minimum required for schools or similar public uses. This speeds siting and lowers barriers for operators and can expand local options for families.

Easier occupancy sign-off for schools

Beginning May 6, 2026, a school can get a permanent occupancy certificate from the authority that did the inspection. If an independent inspector checked the building, the state superintendent can issue it. If a city, county, or district inspector checked it, that official can issue it. These certificates satisfy city or county occupancy requirements.

Local rules for home microschools

Beginning May 6, 2026, cities and counties may require home-based microschools and micro-education entities to follow local rules that do not conflict with this law. Rules can cover parking, traffic and circulation tied to projected students, noise, lot size by student counts, hours, and a business license. Local standards may also set setbacks, height, massing, curb cuts, and construction staging, and limit locations to avoid health or safety risks.

Safety code standards for microschools

Beginning May 6, 2026, a micro-education entity may operate only if its facility follows all local ordinances and meets the International Building Code for Group E occupancy, or the same rules as Class A-1, A-3, B, or M. These code rules can require upgrades and add compliance costs before opening.

Microschool siting: fewer bans, some limits

Beginning May 6, 2026, microschools are exempt from general proximity rules that apply to community locations. If a city or county has zones for sexually oriented businesses or alcohol sellers, it may bar a charter school or microschool from sites that defeat that zone’s purpose. A school can provide a waiver to use such a site.
