Beginning May 6, 2026, if you paid for a required job medical exam, you can file a claim with the Division of Antidiscrimination and Labor. You must file within one year of the date you paid. If your claim is valid, the employer must repay the fee you paid and the cost you paid the provider. The Division can add a penalty up to 5% per day of those amounts, for up to 20 days, until the employer pays. When a penalty is collected, you get 50% of the penalty money.
Beginning May 6, 2026, your employer must pay for any medical exam the job requires for hiring or continued work, including drug tests. You cannot be charged a fee, and the employer must pay any bill from the health care provider. You cannot be made to take the exam outside your shift without pay or forced to use leave. "Medical examination" does not include appointments to take or return from non-work medical leave. Employers cannot make you pay first and then reimburse you.
Beginning May 6, 2026, breaking these exam rules is a class B misdemeanor. The criminal penalty applies to people, firms, and employers who violate the chapter.
