The adjutant general may accept donations for more Guard activities, like a state military museum, the State Partnership Program, humanitarian work, disaster response, and memorials. The National Guard must set rules on who may accept gifts, how they are accepted, which accounts hold the money, allowed uses, bans, and exceptions. These funds do not lapse to the state’s General Fund; they stay available for their intended use.
Cities and towns with land within 5,000 feet of listed military lands must create and keep a compatible-use plan by July 1, 2025, unless they had one on January 1, 2023. Before approving a land-use application in that zone, the city must send written notice to the Utah Department of Veterans and Military Affairs. The department must respond in writing within 90 days and say if the use is compatible with military operations. If the plan is not finished, the department consults with the city and military to decide. For projects that could harm military operations, the city must consider the plan; if an applicant has a vested right, the city does not have to consider the plan.
