Beginning May 6, 2026, police must seize a vehicle if the driver has no driving credential and the officer cannot verify one was issued. The officer must check the Utah Criminal Justice Information System first. Police must also seize a vehicle when they have probable cause of a road‑rage event and arrest the driver. Officers do not have to seize if the driver has an issued but expired license, seizing would harm safety, the driver is under 18, a licensed occupant can drive, or a licensed person can promptly pick up the car with the owner’s OK.
Beginning July 1, 2026, you must pay a $600 administrative impound fee and a $60 testing fee to release an impounded vehicle, plus towing and storage. The State Tax Commission must waive or refund these fees if, within 180 days, you show the Driver License Division decided not to suspend the driver, or you provide a stolen‑vehicle report showing it was stolen at the time. The law also sets where each $600 goes: $29 to the Motor Vehicle Division, $187 to a public safety account, $20 to the Brain and Spinal Cord Injury Fund, and the rest to the General Fund. The $60 testing fee goes to the State Laboratory Drug Testing Account.
Starting July 1, 2026, impound yards may not release a vehicle unless someone present has a valid driving credential and can drive it. Tow and impound businesses must accept cash and debit or credit cards for removals and related services. They must let you take life‑essential items, like medicine or ID, during business hours even if you have not paid; you may remove other loose items after you pay the towing fee. Tow carriers cannot collect removal fees or start storage charges until they file the required impound report.
Beginning May 6, 2026, if you are lawfully stopped with no license and the officer cannot verify one was issued, you give no ID, or the officer suspects a fake ID, the officer takes a quick fingerprint unless safety or equipment limits apply. Agencies must equip every on‑duty officer outside their facility with a portable biometric device by January 1, 2028. Software used for electronic citations must send biometric data to the court system within one year after an agency system goes live.
Beginning May 6, 2026, the division may suspend a driving privilege card if it learns the cardholder’s vehicle registration was revoked. This links card suspension to the vehicle’s registration status.
Starting May 6, 2026, you may not rent a car to someone who is not licensed. You must check the license and compare a signature in the renter’s presence. You may use an electronic system, including optional biometrics, for later rentals, and you must keep rental records open to inspection. Violations are infractions with a minimum $500 fine.
Starting May 6, 2026, the minimum fine is $350 for riding a motorcycle without the required endorsement. The court must waive the fine if you show proof you got the endorsement within 30 days of plea or sentencing, and the court may extend that deadline for good cause. A later repeat offense is a class B misdemeanor and may lead to vehicle seizure.
Starting July 1, 2026, tow operators and officers must send an electronic impound report to the Motor Vehicle Division before noon the next business day. Impounded vehicles must go to a state impound yard. The division may require reports to be filed in a specific online database and can charge reasonable fees to run it. The division must share certain impound details with a designated agent for law‑enforcement or non‑consent tows, and that agent may share with the owner and a verified insurer. A listed impound‑reporting subsection is repealed January 1, 2027.
