Outbreak stops and fines for unsafe milk

Beginning May 6, 2026, the department issues a cease‑and‑desist if it links a producer’s raw milk to an outbreak. It collects samples within two working days. Sales stay stopped until three straight compliant tests are free of listed pathogens or genome sequencing shows no link. Before publicly naming a producer, the department gives notice after a positive whole genome test. Fines may be up to $300 for a first violation, $750 for a second, and $1,500 after that, in addition to suspensions.

Permits and safety rules for raw milk producers

Beginning May 6, 2026, raw milk producers must have a permit. Sales are mainly on the farm and only for home use. Milk must cool to 50°F within 1 hour and 41°F within 2 hours, and stay at 41°F. Each batch must be tested and meet limits: 20,000 bacteria cfu/ml or less and 10 coliform cfu/ml or less. Containers must say "raw milk," show a sell‑by within 9 days, include a safety notice, and use a department color. Permits are suspended if two of four tests, or two in 30 days, fail; reinstatement needs passing tests and full compliance.

On‑farm and small producer permit breaks

Beginning May 6, 2026, two groups can sell raw milk without a permit. On‑farm sellers may sell only to consumers on the premises (or by a designated agent). They must label with a safety notice and a sell‑by within 9 days, cool to 50°F in 1 hour and 41°F in 2 hours, keep 41°F, test coliforms monthly at 10 cfu/ml or less, keep records six months, and notify the department. Small producers making 500 gallons or less in a month who sell on the premises are also exempt, and must notify the department. All exempt sellers remain subject to outbreak rules.

Cow‑share access protected from new rules

Beginning May 6, 2026, the department may not add new limits or requirements on getting raw milk through a cow‑share if you follow the agreement. This keeps current cow‑share access in place.

New testing fees, no permit charge

Beginning May 6, 2026, the department may charge fees for testing and inspections under this program. Those fees stay in a dedicated account to run and enforce the program. The department cannot charge a fee to issue a raw milk production certificate.

Program setup and agency rulemaking

Beginning May 6, 2026, the law defines terms like producer, raw milk, batch, and third‑party vendor. It lets the department set rules for permits, sanitation, testing, inspections, records, labels, and product standards under the state rulemaking process. Producers using the on‑farm or small‑producer exemptions do not have to follow rules made under this part. The old raw milk sale law is repealed.
