Clear rules and choice for electronic estate planning

Beginning May 6, 2026, Utah sets clear rules for electronic estate documents that are not wills. It covers trusts, powers of attorney, health care directives, and more, but not deeds or vehicle, watercraft, or aircraft titles. You choose paper or electronic; no one can require you to use electronic forms or signatures. These rules apply to qualifying electronic documents made before, on, or after May 6, 2026. Utah’s regular estate laws and fairness rules apply the same to electronic documents. Courts aim for uniform results with other states, and this chapter works alongside the federal E‑SIGN Act and other Utah e‑signature and e‑will laws.

Electronic estate papers are fully legal

Beginning May 6, 2026, electronic estate planning documents and signatures have the same legal effect as paper. A required “writing” or “signature” is satisfied electronically. Witnesses can appear by live video; electronic presence counts like being in the same room. Notaries and others can notarize or take oaths electronically. Courts accept electronic records and signatures as evidence. You can show who signed by explaining the security steps used.

Store and print electronic originals

Beginning May 6, 2026, keeping an accurate, readable electronic copy counts as keeping the original. The copy must match the final document and stay accessible as long as the law requires. Extra data used only to send the file does not have to be kept, and agencies can set more rules. You may print a paper copy and certify it by swearing, under penalty of perjury, that it is complete and correct.
