Beginning May 6, 2026, the law creates the Carbon Credit Litigation Fund. The Attorney General deposits money from related judgments or settlements into the fund after being repaid for case costs. The State Treasurer invests the fund and all earnings stay in the fund. The Attorney General must approve spending, and the fund cannot pay general office costs unless they directly support the fund’s legal work. The fund can be used to oppose federal cap-and-trade or mandatory emissions reporting, to address federal actions that support greenhouse-gas claims against the state or create climate remediation programs, and to recover credits or profits lost to fraud. Each year by November 30, the Attorney General reports fund money in, money out, and funded work to a legislative subcommittee.
Beginning May 6, 2026, the law sets clear rules for any carbon credits tied to state work. A state agency must get a digital ID for each credit and report the credit details and any sale terms to the State Auditor before a sale or trade. The Auditor keeps a list and reports the transactions to a legislative subcommittee. The law defines what counts as a carbon credit and a carbon emission offset, and says natural asset credits do not include resource sales or water rights. It says state funds include legislative appropriations and some bonds, but not tax breaks, permits, or federal grants. Credits created or bought by a state agency stay under that agency’s control.
