County sheriffs can set up recovery housing pods inside jails beginning May 6, 2026. These pods serve people who screen positive for a substance use disorder and choose to join. The local substance abuse authority must approve the program as based on best practices, and may use model standards. Programs may include daily structure, peer support, job and money skills, and reentry planning. Authorities may hire outside providers to run approved programs. Pods opened on or before May 5, 2026 do not have to follow the new rules until July 1, 2029.
Beginning May 6, 2026, a court can bar a person charged with or convicted of a drug offense in a specific public place from that place for up to one year. The court may allow narrow exceptions for health care or work. Violating the order is a class A misdemeanor and may also be contempt. Each order must describe the area with street names and numbers and be sent to the Utah Criminal Justice Information System.
Beginning May 6, 2026, judges must consider any local pretrial services that actually exist when setting release conditions. If a money condition is used, the court must follow the state schedule, set one total amount per case, and consider ability to pay and flight risk. Courts cannot base release only on offense seriousness (except capital felonies) or only on a risk score. Judges may require a substance abuse evaluation and following any recommended treatment. If detention is ordered, the court must write clear findings on danger or flight risk. If you are arrested for breaking a jail release agreement or order, you cannot be released before your first magistrate appearance, and release may be denied.
Starting May 6, 2026, justice courts in larger counties may run a treatment‑focused supervision program if the Judicial Council approves and local funding exists. The program uses continuous judicial oversight, rewards and sanctions, drug and alcohol testing, and regular reporting. It can require treatment, including medication‑assisted treatment, based on assessment, and requires work, job search, or school. You must consent to join and agree to sanctions. People with pending violent or sexual charges cannot join; eligible cases are probation‑eligible offenses where substance use is a contributing factor.
Starting May 6, 2026, more groups can run syringe exchange programs, including health agencies, nonprofits, and for-profits. Programs cannot use state funds; they may use city, county, federal, or private funds. Exchanges on public property need written permission from the government that controls the site. Programs may only distribute syringes, not other drug-use items like pipes or straws.
