Orderly plans when facilities close

Beginning May 6, 2026, a facility that plans to close, complete a qualifying sale, or change use must file a transition plan 120 days before the date. At least 45 days before, it must give residents, responsible persons, the ombudsman, and the Division written notice and the approved plan. The plan must list resident needs, options within 60 miles, steps for safe transfers, help for special needs, managed‑care coordination, a timeline, and how the facility stays compliant. After notice, the facility must hold meetings, help each resident find a placement, invite nearby operators, send full records, and give prorated refunds. It may not admit new residents after filing the plan, and it may not close or change use until all residents are relocated.

Court can appoint a receiver

Beginning May 6, 2026, if a facility does not follow these rules, the county attorney or Attorney General can ask a court to appoint a receiver. The court must set a hearing within five days. The court may appoint a receiver with fair pay and needed powers.

Quick sale notice and 60‑day rate freeze

Beginning May 6, 2026, after an acquisition sale, the facility must tell each resident and responsible person within five days. If you lived there at the time of sale, the buyer cannot raise your rates for 60 days. Any later increase must come with 30 days’ written notice.

Stronger notice before resident moves

Beginning May 6, 2026, special protections apply when a facility starts a transfer or discharge. They also apply if you or your responsible person object, the move was not your request, or it conflicts with your care goals. The facility must give at least 30 days’ written notice, unless safety or urgent medical needs require less or you lived there under 30 days. The notice must explain reasons, date, and destination if known, in a language you understand, with a same‑day copy to the ombudsman. Staff must explain ombudsman services and provide preparation and orientation for a safe, orderly move.
