State blocks local gun liability rules

Beginning May 6, 2026, local governments cannot impose civil liability on makers, sellers, or trade groups for criminal misuse, alteration, or modification of qualified products. Any local rules that try to do this are overridden by state law. Businesses face one statewide rule instead of different local rules.

Stronger shield from gun lawsuits

Beginning May 6, 2026, most claims against manufacturers, sellers, or trade groups are barred unless they fit narrow, listed exceptions. To proceed, a claim must plead detailed facts showing the defendant’s culpable mental state and that the defendant’s conduct directly caused the harm. Courts must dismiss claims that do not meet these rules, and winning defendants get reasonable attorney fees and court costs. The law limits negligent entrustment to cases where a seller knew or should have known a buyer would use the product dangerously and the buyer did; harm by someone not directly entrusted does not count. Foreign governments cannot use the listed exceptions.

Who counts as gun makers and sellers

Beginning May 6, 2026, the law sets who is covered. A qualified product includes firearms, ammunition, antique firearms, and accessories, including items made to attach to or be used with them. A manufacturer includes the business and its owners, directors, officers, employees, and agents. A seller includes federal firearms licensees and anyone who sells, imports, exports, wholesales, or retails these products. A manufacturer is not a seller under this law.
