Beginning May 6, 2026, associations must allow water‑wise landscaping where owners maintain their yards and must adopt rules that support it. HOAs cannot stop you from converting a grass park strip to approved water‑wise landscaping. They cannot ban using less water on lawns during drought. They cannot stop vegetation removal on lots in designated wildland‑urban interface areas. Association rules may include design criteria and limits on plant materials.
Beginning May 6, 2026, cities and counties cannot ban water‑wise landscaping on private property. They cannot require lawn or turf in any unimpeded strip under eight feet wide. They cannot block vegetation removal that is required for defensible space in designated wildland‑urban interface areas under the adopted code. Local governments may require site or landscaping plan reviews, set design standards (like mulch types, vegetative coverage, or plant limits), and require healthy maintenance, within the law’s limits.
Beginning May 6, 2026, cities and counties may require sellers of new homes to tell the first buyer about local water‑wise landscaping ordinances. Buyers get early notice of yard rules. Sellers may have a small paperwork step.
