Beginning May 6, 2026, if you are harmed by someone practicing law without a license, you can sue them. If you win, the court must award your reasonable attorney fees and costs. The court may also award damages and issue an injunction.
Beginning May 6, 2026, practicing law in Utah without a Utah license is illegal. It is a class A misdemeanor. It is a third-degree felony if the person lies about being licensed, causes over $1,000 in loss or serious harm to a legal right, or has a prior conviction. The Attorney General and county or district attorneys can investigate and prosecute.
Beginning May 6, 2026, the Utah State Bar board can bring civil cases against people who practice without a license. Courts can stop the person, order client payments returned, and require up to $10,000 paid to the client reimbursement fund. Courts can also award attorney fees and costs to the Bar.
Beginning May 6, 2026, if a court finds someone practiced law without a license in that case, it must award attorney fees and costs caused by it. The court may strike that person’s filings and bar them from appearing. A court may issue an injunction on a more-likely-than-not showing, without proving money loss, and must set fair terms. The court may refer the matter to the Utah State Bar or prosecutors.
Beginning May 6, 2026, the Utah State Bar must sue within three years after the unlicensed work occurred. For ongoing conduct, the clock starts when the conduct stops. You must sue within three years after you discover, or should have discovered, the unlicensed practice.
