Origin records for risky state webpages

Starting January 1, 2027, the Utah Chief Information Officer sets rules for public state webpages used to do a transaction or get a service when fake media could harm residents. Pages must include a digital provenance record with the software or tool name, creation date, a content ID, and any prior content IDs. The rule does not apply to content made before January 1, 2027.

State enforcement and fines for content labels

Starting January 1, 2027, Utah creates the Digital Content Provenance Standards Act and puts the Division of Consumer Protection in charge. The Division may post a public list of violators and set rules to remove names. The director can fine up to $2,500 per violation. Courts can order disgorgement to injured consumers, award attorney fees, and fine up to $2,500 per violation. Courts may add civil penalties up to $5,000 for breaking an order. All fines and penalties go to the Consumer Protection Education and Training Fund.

Big AI and platforms show content origins

Beginning January 1, 2027, AI providers with over 1,000,000 monthly users must add hidden disclosures to images, video, or audio their system creates or substantially changes. The note includes the time and date and signals AI creation or alteration, using widely accepted standards when feasible. Large online platforms with at least 2,000,000 monthly users must detect compliant provenance data, show when it exists, and let users view or download it. Platforms may not knowingly remove compliant provenance data or signatures when it is technically feasible.

Device makers add hidden source tags

For capture devices sold in Utah on or after January 1, 2028, manufacturers must add a hidden disclosure in captured content. The tag shows the maker’s name or a device signature and the time and date of creation or change. Makers may let users turn the tag off. These duties apply only when technically feasible and aligned with widely adopted standards.
