Buyers must disclose foreign military service

Beginning May 6, 2026, if you buy land in Utah, you must tell the county recorder on the state form if you served in the military of a restricted foreign entity. File the form in the county where the land is located. Not filing that disclosure is a third-degree felony.

State process to flag illegal land deals

Beginning May 6, 2026, the Department of Public Safety keeps a public list of restricted foreign entities. County recorders can report suspected illegal land deals to the department. After a report, the department sends each party a letter and gives 30 days to show they are not restricted. If they do not respond or clear it, the department notifies them the deal violates the law. They have one year to give up the interest or the state will sell it. The department can fine $500 for each day after the 30 days that a party does not respond; fines stop on the day the interest is sold. County recorders make a public record of violations, are shielded from liability, must offer the military‑service disclosure form to buyers, and send any completed forms to the department.

Stricter ban on foreign-controlled land buys

Starting May 6, 2026, restricted foreign entities cannot acquire any interest in land in Utah. The law treats companies owned or controlled by China, Iran, North Korea, or Russia, and companies they own at least 25% of, as restricted. It is a third-degree felony to buy or lease land for a restricted entity or to use its funds to do so. Any restricted entity that holds land must give up that interest under the state’s process.
