Beginning May 6, 2026, new reinvestment fee covenants are capped at 0.5% of property value, or 0.25% in low‑amenity associations. The caps do not apply in large master planned developments and only cover covenants recorded on or after that date. An association cannot charge a reinvestment fee unless its declaration or a covenant allows it and a majority of voting owners approve (or more if rules require). If the association is not a large master planned development, at least 50% of each fee goes to reserve funds. The law also lets associations use reinvestment fees for major, long‑life infrastructure work that needs advance funding.
An association transfer fee imposed on or after May 7, 2025 is void unless it only covers transfer‑related costs. This rule takes effect May 6, 2026. It lowers or removes fees that are not tied to actual transfer work.
Beginning May 6, 2026, associations must state in their registration if they charge a reinvestment or transfer fee. They must register within 90 days after recording a declaration and update yearly and within 90 days of changes. The Department of Commerce posts simple guides on HOA law, rights, and how to form or end an association. The HOA Ombudsman also posts a notice that buyers cannot rely on the registration disclosure when preparing purchase documents and should verify fee terms.
