Temporary assessments on large renewable owners

From January 1, 2026 through December 31, 2027, each renewable energy parent entity with operational facilities in the state pays an annual Energy Project Assessment before March 1. Tiers: 500+ MW $200,000; 200–499 MW $175,000; 100–199 MW $125,000; 50–99 MW $50,000; 20–49 MW $25,000. From January 1, 2027 through December 31, 2028, parent entities also pay a smaller annual Recycling Study Assessment for wind or solar facilities, with tiers from $2,500 to $20,000. Entities must file an electronic, sworn capacity report by March 1 each year; the Tax Commission collects the payments. Energy Project revenue goes to the Species Protection Account; Recycling Study revenue goes to the Solar Panel Waste Restricted Account. Part 14’s assessment authority remains in law through December 31, 2028.

Solar panel recycling study and fund

The law creates a Solar Panel Waste Restricted Account to fund recycling, safe disposal, testing, and study costs, subject to appropriation. Money can come from fees, fines, appropriations, donations, and interest. The division must study recycling methods, hazardous-waste reduction, material recovery, and funding and registration options. A progress report is due by November 30, 2026, and a full report by July 1, 2027.

Testing and disposal rules for solar panels

Beginning July 1, 2028, the division can require hazardous-waste testing for panels that are damaged beyond salvage or going to a landfill. If a panel tests hazardous, the owner must follow state disposal rules set by the board. Landfills cannot accept solar panel waste unless they register as a solar panel waste site or the waste is shown not hazardous. The board sets testing, identification, and disposal rules, and the division runs and enforces the program. Violations can be fined up to $10,000 per day.

Stronger solar sales disclosures for homeowners

Solar retailers must tell you that the state may require you to pay for hazardous testing before disposal and to follow disposal law. The notice must warn that not following the rules can bring civil fines up to $10,000 per day. If the retailer will not get your utility interconnection approval, the disclosure must say so and explain what you must do to connect.

Small solar systems pay 2026–27 fee

Beginning January 1, 2026, small-scale solar entities must pay a per-system fee on systems installed on or after that date. Systems 2 MW or less pay $10; systems over 2 MW and under 20 MW pay $500. The division may collect it once in 2026 and once in 2027. Money goes to the Solar Panel Waste Restricted Account.
