Beginning July 1, 2026, school districts and charter schools must give paid family leave: up to 3 work weeks of parental leave, 3 weeks of postpartum recovery, 6 weeks of adoption leave, and 4 weeks of foster leave. Policies cannot be more restrictive than state employee rules, and this leave cannot be charged to your other paid leave. Part-time and nonstandard-hour staff get prorated leave hours. Your LEA must give you written notice of these rights and how leave sharing works. LEAs cannot retaliate against you for using this leave.
Beginning July 1, 2026, your LEA may set up a leave-sharing program so coworkers can donate or use shared leave for sick, annual, parental, postpartum, adoption, or foster leave. An LEA may also offer more paid leave than the state minimums. LEAs may use leave banks or coordinate with other schools to manage costs.
Beginning July 1, 2026, state employees in Title 49 retirement positions who give birth at 20 weeks or later qualify for postpartum recovery leave. They must also accrue paid leave and not be reemployed retirees. Adoption leave applies to Title 49 employees who legally adopt a young child and are not the spouse of the existing parent. Foster leave applies to Title 49 employees who are foster parents. These groups are defined as qualified employees for these leave types.
Beginning July 1, 2026, a woman may breastfeed or use a breast pump in any place of public accommodation. The law defines breastfeeding to include lactation and defines breast pumps, making the rule clear for businesses and parents.
