Stops drugmaker limits on 340B drugs

Beginning May 6, 2026, the law stops drug makers from limiting the 340B drug program. They cannot block pharmacy–covered entity contracts or deny access to their drugs. They cannot limit 340B acquisition, dispensing, or delivery to approved sites, unless federal law forbids it. They cannot impose time limits on replenishment or claims, force 340B purchasing where others can buy non‑340B, or require claim or contract data unless federal law requires it. They also cannot interfere with these contracts. These rules do not conflict with federal law.

Public employees' health plan can adjust

Beginning May 6, 2026, the public employees’ health plan (PEHP) can change its business practices to offset financial impacts from this 340B law. Any changes must only aim to reduce those impacts.

When these 340B rules start

The law’s normal start date is May 6, 2026. It can start earlier if two‑thirds of each house approve and the governor signs. If approved without the governor’s signature, it starts the day after the constitutional time limit. If passed by veto override, it starts on the override date.
